1.            User Agreement: Terms & Conditions

Welcome to the Auction website of Dar Tal-Providenza. By virtue of the following any natural or legal person, who registers, uses, bids or purchases an item, shall be entering into a contractual agreement with Dar Tal-Providenza, which is reflected in these ‘Terms and Conditions’, and hereinafter regulated as such. The users shall themselves be responsible for their bids, and as such bind themselves to honour such bids, inter alia by paying any amounts stipulated in return for the items auctioned or sold on this website.

Thus before one becomes a member and a bidder of this website, one must read and accept all of the terms and conditions in, and linked to, these User Agreements and the Terms and Conditions. By accepting this User Agreement and Terms and Conditions, the User shall enter into a legally binding agreement between himself/herself and Dar Tal-Providenza, for all intents and purposes of the law.

While using this website, users shall not:

    • post, list or illegally try to upload content or items in or of an inappropriate nature;
    • fail to deliver payment for items purchased, unless the user has either cancelled the bid (see Cancel a Bid) or has clear and good motives, such as typographical errors, that could mislead the sale of an item.
    • manipulate the price of any item or interfere with the listings;
    • take any action that may undermine the bidding or selling process;
    • distribute viruses or any other technologies that may harm the website of Dar Tal-Providenza;
    • copy, modify, or distribute rights or content from this website, or otherwise inappropriately use Dar Tal-Providenza trademark and logo;
    • harvest or otherwise collect information about users, including email addresses, without their consent.

If one is registering as a business entity, such representation means that the user has the authority to legally bind that entity. If as a User one is bidding as a business, one must also comply with all applicable laws relating to online trading.

On the other hand, Dar Tal-Providenza will ensure its users that:

    • it will not breach any laws, or sell any counterfeit items, or otherwise infringe the copyright, trade mark or other rights of third parties;
    • It will sell items donated or given to it and use the information given by the donators, without being obliged to make any background checks, relying solely on the generosity and truthfulness of its benefactors;
    • It will not fail to deliver items purchased by the user, unless the user fails to meet the posted terms and conditions, or the item was damaged or stolen while still in our possession – see Payments;
    • It will not circumvent, change or manipulate the simple fee structure in use, and the User will always pay the displayed final price. There will be no other additional costs unless required by the Laws of Malta, or if the User decides to make a further donation to Dar tal-Providenza;
    • It will not post false, inaccurate, misleading, defamatory, or libellous content (including personal information);
    • It will not transfer your account details and user ID to another party without our consent;
    • It will not distribute or post spam, unsolicited or bulk electronic communications, chain letters, or pyramid schemes;

Dar Tal-Providenza reserves the right to limit user activities on this site (including, without limitation, restricting and in extreme cases cancelling any number of items a user may bid for), if Dar Tal-Providenza thinks that such restrictions will improve the security of the website or reduce Dar Tal-Providenza’s other user’s exposure to financial or other liabilities.

Dar Tal-Providenza also reserves the right to cancel unconfirmed accounts or accounts that have been inactive for a long time or to modify or discontinue suspicious accounts and account holders that cannot be communicated with over a period of time to verify their account details. As a user one also agrees not to hold Dar Tal-Providenza responsible for any loss one may incur as a result of these actions being taken.

No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

2.            Registration and use

By registering the User enters in a contract whereby which he or she agrees to all the "Terms and Conditions". The data provided by the user must be truthful and complete. If there is a change in the data, the user is obliged to correct them promptly. When registering the user’s username will be one’s email, and password can be selected. The username will not be shown on the system and instead a Bidder’s number will be seen, that will keep the User’s anonymity to other Users and need not be remembered, as the system will remember it for you once one registers. The password must be kept secret. If the username or password have been forgotten or misplaced by the respective users one can ask the system to send an email with a reminder, if the security questions set in when registering are replied to correctly. A user, is in principle free to open multiple accounts. Violations of any regulations will result in exclusion from the Dar Tal-Providenza website. These policies help to create a safe, fair and enjoyable environment for all users. As a buyer, a user is responsible for reviewing, understanding and accepting these policies, as well as all applicable laws and regulations outlined in the User Agreement.

The User is responsible for his/her account and shall be responsible for any bid affected in the name of that account. Any representation to that effect through any bid through that account that was not authorised by the User shall not be acknowledged by Dar Tal-Providenza and shall not be deemed valid, if Dar Tal-Providenza is informed as soon as this misrepresentation is identified by the User.

User identity is a building block of the trust on this website between members and Dar Tal-Providenza, and as such is treated with the utmost importance. Users on the other hand are expected as members to do the same. As such, users:

    • can't misrepresent their identities.
    • must always provide valid and complete contact information.
    • for everyone's safety, members are never permitted to publish the contact information of other members in an online public area.
    • Every membership must always have a valid email address and a telephone number to be contacted on until the end of the auction.
    • Users must be at least 18 years old and are able to pay for items they commit to buy (either by winning the item or using Buy it now).
    • The Users will not make any unreasonable demands to Dar tal-Providenza, or taking advantage of our protection systems.
    • Users will not bid on or buy an item when they don't meet the terms as outlined in the item listing, or bid or buy with the intention of disrupting a listing.

If any Users get to know or are aware of any policy breach, they are requested to report this via email to Dar Tal- Providenza on

Multiple emails about the same case slows any possible investigation. Due to privacy issues, it is not possible for Dar Tal-Providenza to discuss the results of any investigation but it will investigate any reported abuse. However whether action or not is taken will be solely up to the discretion of Dar tal-Providenza.

Alternative methods of making a bid during the Auction on the 1st January.

During this annual auction, bids can also be accepted by phone (which will be advertised and notified during the auction) or in person at Dar Tal-Providenza where the Auction will be held. Persons making a bid by phone or in person will still require to register their details as per items 1, 2 and 3 above, and all Terms & Conditions listed in hereunder are also applicable.

Registering when bidding by phone or in person needs only to be done once, as details will be taken and a reference will be given to the bidder to enable quick and multiple bids, as the case may be. However there is a limitation when bidding by phone or in person that needs to be taken in consideration. Bidding lines will be disconnected 15 minutes before the end of the auction. This is because the Auction has a precise time when it finishes and from experience phone calls keep coming in after the end of the Auction. As it is physically impossible to be able to register a bid by phone in the last few minutes, phones will be de-activated 15 minutes before.

Persons bidding personally on the day can do so at the Auction desk. Registration is mandatory and once this has been done and then during the day any number of bids can be made on any item in the Auction. As the same issue with the phone bids may be experienced, during the last 30 minutes of the Auction, a special sealed box will be made available. Bidding sheets will be made available to anyone present and up till the end of the auction bids can be entered into this box against any item available. To assist these bidders, a screen with the latest bids will be available to show the latest bid registered online, so bidders can enter bids up till the end of the Auction. When the Auction ends, the sealed box will be immediately retrieved and bidding will be officially closed.

Bids done by phone or in person that are not in line with section 8 of these Terms & Conditions will automatically be requested to correct their bid by the Auction Administrators, as otherwise their bid cannot be entered. If this is not accepted by the bidder bidding by phone or in person, then the bid is disqualified automatically, and cannot be registered.

4.            IMPORTANT: Procedure for winning bids

At the end of the Auction, all items will have their bidding status as SUSPENDED. This will allow the Auction Committee to review the final bids entered in the Hall against the bids online. Bids entered by phone would have already been registered and entered before the end of the Auction.

Once this data is entered in the system then the following procedure will be followed:
1. If any items were BUY NOW the winning bidders will be called to confirm their winning bid during or at the end of the Auction and the status of the item will be put to CLOSED.

2. If the last bids on any item results to be only one, whether by phone, email or in person, then the status of that item will become CLOSED and the winner will automatically be the only bidder with a highest bid

3. Phone and in person bids will be last taken 15 minutes before the suspension of the auction at 8.45pm.

4. At 09:00 pm the Auction will be suspended.

5. For the rest the items, the bidders who have bid during the Auction, by phone, email or in person, will be called all simultaneously by phone, one item at a time, while any bidder present that has made a bid in the last minutes will also be ask to approach the Auction Administration desk. Then a live auction will be held exclusively, with the final bidders only, there and then until the final bid is agreed and thus the winning bidder decided. This information will be loaded on the system, and item status will be closed. It is thus very important to leave the phone line or mobile contact number free immediately after the end of the auction as you will be called to confirm your final bid and given the opportunity to up your bid against present bids.

6. All items will be checked against this procedure until all items are decided, one by one and their status updated accordingly – that gives the opportunity for all bidders that have bid online, by phone or in person, with an interest in any item. The number of bidders called during this stage will be only those who have entered a valid bid, by phone, online or in person.

7. Any bidder that does not reply to the phone call on the number given at registration or will not be in the hall during this last stage of the Auction, will be deemed to have forfeited his right to review his or her bid in this last stage of the Auction. It is thus important to ensure that the Auction Administration have the correct contact details, and that the bidder ensures his/her line is free in during the final stages of the auction and sometime later. An attempt to contact the final bidders will be done once, barring that the bidder/s that would be contacted would then participate in the final outcome of the bid.

8. At the end of the live auction the winning bidder will be notified and the status of the item will be updated and CLOSED.

It is thus important for all bidders to bid the best bid they can when they are bidding especially if they cannot check the status of their bids or are bidding by phone, before the last 45 minutes of the Auction, or cannot be contacted after the end of the Auction. The Auction process has been modified in order to include and allow all final interested bidders to have an equal opportunity to own one of the items on Auction.

If after 7 days no effort has been made by the winning User to contact Dar Tal-Providenza, and if Dar Tal-Providenza also fails all endeavours within those 7 days to contact the User, an email will be sent to notify the winner bidder that the second highest bidder will be contacted,. If the winning bidder was the only bidder, the item will be removed, and reissued for bidding, at the discretion of Dar Tal-Providenza. However if the User is abroad or unable to contact Dar Tal-Providenza, then either an email ( or a phone call (21462844) to postpone the collection can be done. Otherwise, it will be deemed that the User has forfeited his win, and could be listed as an Abusing User and consequently Dar Tal-Providenza is free to take any action as listed in the section Actions on Abusing Users. In cases where the winner is abroad and has no one that can pick the item, Dar Tal-Providenza will at its discretion, ship the item by post or courier service, but at the cost of the winning User. 7.            Payments

Joining this website as a User and bidding on listed items is free. Dar Tal-Providenza does not charge fees for using this service but Users are encouraged if they can to either Donate or make bids to help Dar Tal-Providenza as a Charity that is an institution aimed at helping, supporting and looking after disabled persons throughout their life, giving a unique and invaluable service that would otherwise not be there. As such Dar tal-Providenza works solely on providence and with the generosity of each and every one of you. Donating items helps but buying these items helps more as it give this Charity the much needed funds to do this work, which currently amounts in excess of €3,000,000 every year as running costs for over 100 residents.

A user may close an account without penalty and after all the dues have been paid by collecting any item won or purchased, by giving due notice. Dar Tal-Providenza will do so within 30 days of such notice being given. There is a permanent Donate facility to this website and may post the temporary promotional events or new services on the site aimed at fund raising for Dar Tal-Providenza only.

Unless otherwise stated, all fees are quoted in Euros (€). You are responsible for paying all items won or purchased in a timely manner with a valid payment method by cheque or cash (or other options that may be later introduced) and also of collecting the items from Dar Tal-Providenza. Please call on 21462844 prior to visiting Dar Tal-Providenza to collect the item, to ensure the item/s are set aside for you.  If your payment method fails, we may collect fees owed using other collection mechanisms or by taking legal action and informing local authorities. A user also agrees that Dar Tal-Providenza, as a Charity, shall issue the buyer with invoices as required, in electronic format, by email, or given to buyer manually on collection.

8.            The Bidding Agent

The Bidding Agent is an automated system, that when in use,  can automatically manage your bid, similar to other international auction sites. The other alternative is to have a Direct or English Auction, and in this case when a bid made, the value of the bid is listed without any reserves. Whether an auction is managed by the Bidding Agent or is a Direct Bid, this is solely decided by Dar Tal-Providenza, and the users are notified prior to bidding which bid system is in place. There can be also items listed on BUY NOW price and can be purchased there and then on the day of the Auction, online, by phone or in person by the first bidder that offers the listed price. These items once sold will be listed as SOLD or CLOSED and reserved for collection as detailed above.

When the Bidding Agent is in use, and a bid is entered by a user, the Bidding Agent will automatically manage the bid of the User to retain the lead, in specified steps of the sequence described in the table below, until the maximum of the User’s bid is reached, in which case, the Bidding Agent will allow the next highest bidder to take the lead.

If a new bid is lower than the allowed lowest bid, the Bidding Agent will automatically disallow a new entry. No further action is required by the User and the Bidding Agent will be always active till the end of the Auction, and will allow only the highest bid at any one point in time to lead the auction on any particular item. If a User is outbid during an auction, the user will receive a notification email. A winning bid will also generate an email to the winning user by the Bidding Agent.

The Bidding Agent will not be active when an item is being sold as Buy Now thereby having a fixed price, where the latest highest bid automatically replaces the previous best bid, at whatever value that is. Those bids entered after the specified time in Article 4, during a classic Direct / English style auction, will entitle those bidders only to an exclusive Live Auction, as specified in Article 4.

The Bidding Agent, when activated will increment your bid against other bids, automatically in all cases, and instantaneously declare the highest bidder, as per the specified ranges listed below. Once a limit in the table below is reached, the next bid cannot be less than the increment. The Bidding Agent will automatically disallow any entry that is less than the Minimum Increment.

Bidding Value – Price range in Euros

Minimum Increment in Euros

From (€)

To (€)

40,000 onwards

Should an auction be held live by Dar Tal-Providenza, the increments of each item shall be decided by the Auctioneer presiding the auction and may not follow the table above prescriptively.

9.            Prohibited Articles

Dar Tal-Providenza will sell items that are not prohibited or infringe any local or international law. As all its items are donated, Dar tal-Providenza will endeavour to ensure that the items are owned by the donor but if that is not the case, then Dar Tal-Providenza cannot be held liable or responsible including any of its officers, directors, agents, subsidiaries and employees.

10.            Content

For the convenience of the Users, we try to offer PDF catalogues when possible of the different auctions with images we take, descriptions and product specifications, which are provided by third-parties (including other Users or donors), which users may use, solely in connection with their purchases or bids during the time they are subscribed to this website.

While the volunteers of Dar Tal-Providenza try to offer reliable data, users cannot expect that the catalogues will always be accurate and up-to-date, and any user shall agree that they will not hold Dar Tal-Providenza as catalogue provider responsible for any inaccuracies.

If as a User or Donor, you are donating items or wish to refer our catalogues or auctions or sale of items, it is urged not to give Dar tal-Providenza misleading information, and fully comply with these Terms & Conditions and User Agreement, and all policies within. The catalogues may include copyrighted, trademarked or other proprietary materials which Dar Tal-Providenza shall use solely to describe the item and not to market it.

11.         Notification Mails from our Website

There only a limited number of emails Dar Tal-Providenza Auctions website will send to its Registered Users.

The very first email a user will receive is to enable registration, and this is explained in the Registration section.

Once a user starts bidding, if such bid was the highest, and then outbid, an email will be sent to the user to notify that he/she has been outbid from Please do not reply to the email, as this email address is not monitored and it is an automated information service.

If a user wins an auction by placing the highest bid, another email will be sent notifying the user from the same account. This time the email will give the user the information as per the section Payments, and will direct the user on how to call and arrange for the picking up and paying for the item won. Users are urged to configure their email filters so that no messages sent from address are sent to SPAM.

Users are urged not to overload the system by responding to these emails. It is better to call on 21464606 or the bidding number advertised on the day, to ask any queries or clarifications. If Dar Tal-Providenza cannot help you immediately, our support staff shall return your call if you leave them your contact details.

If a user receives the outbid email, one can immediately go the website and increase the bid, by pressing on the same email, unless the auction has already ended. This email will not be sent if the time of the auction has expired. The user can always check on the website the winning bid. It is best to check for emails to ensure that a bid is the highest, or by refreshing on the page of the item/s one is bidding. It is thus ideal for any user to put the highest bid possible at any point in time, to avoid disappointment.

If anyone has any queries, please send them to admin email as per Contacting Us. We shall endeavour to reply to your email in 48 hours but we cannot guarantee a response on one day auctions. In that case we suggest you call for any query.

12.               Privacy

Dar Tal-Providenza uses user information only for its fund raising events. However in such cases user details will also be stored on another system to ensure the user making the bid and receiving the item is a real or natural person.
